国务院关于废止第二批涉外法规的通知(附英文)
国务院
为了加快实施沿海地区经济发展战略，促进我国沿海地区外向型经济的发展，国务院有关部门根据国务院关于清理涉外法规的部署和要求，对国务院发布或者批准发布的现行涉外方面的行政法规和法规性文件（以下简称法规）进行了清理。清理出来的第二批应予废止的法规12件，经
国务院清理涉外法规领导小组和国务院法制局逐件复查，国务院审议，决定予以废止（法规名称见附件一）。
同时清理出来的第二批自行失效的法规16件，也经国务院清理涉外法规领导小组和国务院法制局逐件复查，现一并附后（法规名称见附件二），以便各地区、各部门全面了解已失效的涉外法规的情况，利于工作。

CIRCULAR OF THE STATE COUNCIL CONCERNING THE ANNULMENT OF THE
SECOND BATCH OF REGULATIONS GOVERNING FOREIGN-RELATED MATTERS
(September 27, 1988)
In order to speed up the implementation of the strategy for economic
development in the coastal areas, and to promote the development of
export-oriented economy in the coastal areas of our country, the
departments concerned under the State Council, in accordance with the
planning and requirements of the State Council for the sorting out of
regulations governing foreign-related matters, have undertaken the sorting
out of the existing administrative regulations as well as other legal
documents (hereinafter referred to as "the regulations", for short),
promulgated by the State Council or promulgated with the approval of the
State Council. At present, the second batch of twelve regulations, which
have been sorted out and should be annulled, have been re-examined, piece
by piece, by the Leading Group under the State Council for the Sorting Out
of Regulations jointly with the Bureau of Legislative Affairs of the State
Council and by the State Council: and it is decided to announce the
annulment of the aforesaid regulations (See Annex I for the titles of the
aforesaid regulations). At the same time, the second batch of sixteen
regulations, which have become invalid automatically, have also been
sorted out and reexamined, piece by piece, by the Leading Group under the
State Council for the Sorting Out of Regulations jointly with the Bureau
of Legislative Affairs of the State Council: and now these sixteen invalid
regulations (See Annex II for their titles) are also included here as
Annex II in order to help various regions and departments concerned obtain
an overall understanding of the condition of those invalid regulations
Governing foreign-related matters, thereby facilitating their work.

各区、县劳动和社会保障局，市属各委、办、局、总公司劳资处，各中央在京企、事业单位，社会团体：
为进一步完善社会保险体系，保障农民工的合法权益，针对《农民合同制职工参加北京市养老、失业保险暂行办法》（京劳险发[1999]99号）在执行过程中出现的一些新情况，根据国务院《社会保险费征缴暂行条例》（国务院令1999年第259号），以及劳动和社会保障部有关规定精神，现制定《北京市农民工养老保险暂行办法》，请遵照执行。

附件一：
北京市农民工养老保险暂行办法
第一条 为进一步完善社会保险体系，保障农民工的合法权益，根据国务院《社会保险费征缴暂行条例》（国务院令1999年第259号），以及劳动和社会保障部有关规定精神，制定本办法。
第二条 凡本市行政区域内的国有企业、城镇集体企业、外商及港、澳、台商投资企业、城镇私营企业和其他城镇企业，党政机关、事业单位、社会团体，民办非企业单位，城镇个体工商户（以下统称：用人单位）和与之形成劳动关系、具有本市或外埠农村户口的劳动者（简称：农民工），应当依法参加养老保险，缴纳养老保险费。
第三条 用人单位招用外埠农民工应当经市、区（县）劳动保障行政部门批准，并办理《北京市外来人员就业证》（以下简称：《就业证》）；招用本市农民工应当到劳动力输出地区（县）劳动保障行政部门办理招聘备案手续，并填写《北京市用人单位招用本市农村劳动力花名册》。同时，用人单位应自招用农民工之月起，必须与其签订劳动合同，并为其办理参加养老保险手续。
经市、区（县）劳动保障行政部门批准，已经办理了招用农民工手续，而尚未为其办理参加养老保险手续的用人单位，应自本办法下发之日起一个月内，到为本单位城镇职工缴纳养老保险费的社会保险经办机构，办理农民工参加养老保险的手续，并为农民工缴纳养老保险费。
新成立及尚未参加养老保险的用人单位，到企业营业执照注册地或单位所在地的区（县）社会保险经办机构，办理社会保险登记手续，并为城镇职工、农民工申报缴纳养老保险费。
第四条 用人单位在为农民工办理参加养老保险时，应向社会保险经办机构提交下列证明和材料：
（一）用人单位的《社会保险登记证》；
（二）企业法人营业执照（副本），个体工商户营业执照（副本），事业单位法人证明书（副本）或机关行政介绍信；
（三）上报统计部门的《劳动情况表》（年报104表）；
（四）市、区（县）劳动行政部门批准使用农民工的证明；
(五）用人单位使用外埠农民工，要提供《就业证》；
（六）《北京市用人单位招用本市农村劳动力花名册》。
第五条 养老保险费由用人单位和农民工共同缴纳。用人单位以上一年本市职工月最低工资标准的19%，按招用的农民工人数按月缴纳养老保险费。农民工本人以上一年本市职工月最低工资标准为基数，2001年按7%的比例缴纳养老保险费，其个人缴费由用人单位在发放工资时代为扣缴。个人缴费的比例，今后随着企业职工缴费比例进行统一调整，最终达到8%。
第六条 用人单位为农民工缴纳养老保险费，由社会保险经办机构以“委托银行收款（无付款期）”结算方式委托用人单位的开户银行按月扣缴。
第七条 用人单位为农民工缴纳养老保险费，原则上应按城镇职工缴纳养老保险费的缴费渠道和缴费方式进行。但对使用农民工较少或使用农民工相对稳定，按月缴纳养老保险费不方便的用人单位，经社会保险经办机构同意，签定协议后，可以选择按季度、半年、一年的方式缴纳养老保险费。
第八条 社会保险经办机构为农民工按缴费工资基数的11%建立养老保险个人帐户。
第九条 农民工的个人帐户存储额，按北京市企业职工基本养老保险个人帐户计息办法执行。
第十条 农民工个人帐户存储额，只有在本人达到养老年龄时，才能支取。农民工在达到国家规定养老年龄前死亡，其个人帐户存储额中的个人缴费部分可以继承。
第十一条 农民工与用人单位终止、解除劳动关系后，在本市行政区域内重新就业的，可以接续养老保险关系，由社会保险经办机构接转其缴费记录。接续时，只接续养老保险关系，不转移养老保险基金；跨统筹区域就业的，可以转移养老保险关系，其个人帐户全部随同转移；回农村的，可以保留养老保险关系，将其个人帐户封存，作为其接续养老保险关系的依据，待在本市重新就业后，继续缴纳养老保险费，其缴费年限可以累计计算。并凭社会保险经办机构开具的缴纳养老保险费凭证办理转移、接续、清算、终止养老保险关系等手续。
第十二条 农民工必须达到国家规定的养老年龄（男年满60周岁，女年满50周岁），方能领取基本养老金。基本养老金暂按享受一次性养老待遇处理，其待遇由两部分组成：
第一部分：个人帐户存储额及利息一次性全额支付给本人。第二部分：按其累计缴费年限，累计缴费满12个月（第1个缴费年度），发给1个月相应缴费年度的本市职工最低工资的平均数，以后累计缴费年限每满一年（按满12个月计），以此为基数，增发0.1个月相应缴费年度的本市职工最低工资的平均数，并计算到月，保留一位小数（计算公式见附件二）。
第十三条 本市籍农民工在与用人单位终止、解除劳动关系后，可以按本办法第十一条保留养老保险关系，封存个人帐户，待重新在本市就业后，继续缴纳养老保险费。原已参加本市农村养老保险的，也可将其在用人单位工作期间养老保险个人帐户存储额和按规定核算的待遇转移到其农村养老保险个人帐户中；没有参加本市农村养老保险的，可在其户口所在地农村养老保险管理机构参加农村养老保险，新建个人帐户，同时将其在用人单位工作期间养老保险个人帐户存储额和按规定核算的待遇转移到其新建个人帐户中，并按本市农村养老保险的有关规定享受相应的待遇。
第十四条 用人单位招用农民工不为其办理审批、录用手续，不为其办理参加养老保险手续的，劳动保障行政部门按照国家及本市有关规定予以处罚。
第十五条 因用人单位未参加养老保险或未按规定足额缴纳单位与个人的养老保险费，致使农民工不能按规定享受养老保险待遇的，用人单位应按照本办法的标准予以补偿。
第十六条 《农民合同制职工参加北京市养老、失业保险暂行办法》（京劳险发[1999]99号）中有关养老保险的内容按本办法执行。
第十七条 在国家有关农民工参加养老保险政策出台后，本办法将作相应的调整。
第十八条 本办法执行中的具体问题，由市劳动和社会保障行政主管部门负责解释。
第十九条 本办法自2001年9月1日起施行。
附件二：
关于农民工参加养老保险享受第二部分基本养老金待遇的计算公式
累计缴费是整年度（满12个月）的待遇计算公式为：
∑an ×（1÷x ）×∑bx
其中:a1 = 1,a2 = 1.1,a3=1.2……an = 1+(n-1)×0.1
∑an = n×(a1 + an )÷2
最后一年累计缴费出现不满一年情况的，这部分待遇计算公式为：
缴费相应年度本市职工最低工资的平均数÷12×缴费月数
n为其累计缴费年限（满12个月）；an为第 n年的待遇计算系数；∑an为第一年至第n年的累计待遇计算系数之和; x为相应缴费年度之和；bx为今后第x年的本市职工最低工资；∑bx为从缴费第一年至今后第x年相对应的全市职工最低工资之和。
